Dear Readers,

i am new to this forum, though been reading this forum on and off but still need professional advise

i applied for Student visa by 2008, got refusal due to financial sponsor who denied when he got a call from UKBA verification Department, however based on this the decision was declared for a refusal under 320( 7a) and meanwhile i was got the update, i had another visa in my hand for Saudi Arabia and i left before my passport was returned from UKBA( i got a new passport ) the gap is 15 to 18 days.

however i got married in october 2011 and now in process of applying spouse visa

my Questions,

1- i have read and seen at UKBA web site that 320 7a is not applicable only if... '' ( (7C) Paragraph 320(7B) shall not apply in the following circumstances:

(a) where the applicant is applying as:

(i) a spouse, civil partner or unmarried or same-sex partner under
paragraphs 281 or 295A,

(ii) a fiancé(e) or proposed civil partner under paragraph 290,

(iii) a parent, grandparent or other dependent relative under paragraph 317,

(iv) a person exercising rights of access to a child under paragraph 246, or

(v) a spouse, civil partner, unmarried or same-sex partner of a refugee or person with Humanitarian Protection under paragraphs 352A, 352AA, 352FA or 352FD; or) ''

2- are there any objections in above said case and what would be my status under this application.

My Wife is A british National and residing in UK since past 25 years
i was advised by a law firm consultant to arrange following documents from uk in order to start processing my application.

* Sponsor Invitation
*Copy of Uk Passport
*Employment Letter and Salary Slip ( 2 months)
*Accommodation Proof
*Birth Certificate of Spouse
*Bank Statement ( 3 months)
*Home Survey Report by Council
*Tax Bills
*P60
*Utility Bills
*Email Prints, Pic, phone call records
*Exit Re Entry Visa Stamps



and from my Side, my ready things are

* Ielts( General 6 Over All)
* Bank Statement
* Marriage certificate
* Snaps, Shopping, Food Bills etc
* Call Records
* Face Book Skype Email Prints
* TB test( to be made when applied)
passport Copy + ID card Copy and Pictures

My Questions:

*where do i fall in this category, i checked, confirmed with some of the people around and being told that for sure i am going to get Visa, but i have to declare my self that i got a 320( 7a) what ever the circumstances were recorded based on evidences found while the application was filed....!
* How long it may take to process, 6 weeks or longer then that.
* and most important, i need professional advise from people who are well aware of this scenario.

And i never been or deported from Uk or any other country
i been to KSA for an year only and then came back home

what do you mean by a 'general category visa under spouse sponsor'?

i just need to know that would it help me to win the case based on my previous 320( 7A) under spouse sponsor...?

what visa are you applying for? Are you applying as a visitor or are you applying for a settlement visa?
