ILR Success Croydon WP x 2

Hi All,

I thought I would share my experiences with my ILR success since even though this forum was very helpful there were a few things which stressed me out a lot and hopefully I provide some new insight.

It would appear that P60's provide a very strong case for one's application. I was asked whether I had P60s during the document check when first going into the building. Also my caseworker returned many documents to me but made a point of retaining the P60s. The documents the case worker discarded (almost with disdain!) where:

a) Excess bank statements over 3 months.
b) P45 from previous job.
c) Letters from Home office.
d) Original Work Permit.
e) Flight tickets (proving re-entry from Ireland since there is no stamp for returning from Ireland).

The documents which the case worker scrutinized were:

a) Absences from the UK - it appeared that these were checked against some records on the system.
b) Letter from current employer: SOC code and salary (in the letter from current employer).
c) Payslips (3 months only)
d) P60's

In short whilst the staff were very friendly, it appeared that he was a bit irritated that I had supplied more papers than he needed. He did photocopy all of my documents himself.

Another thing to note is that he didn't seem concerned that:
a) I had no stamps returning from Ireland.
b) I had a gap in employment of 8 days between jobs. (however, I must emphasise that there was no break in WP or leave to remain throughout the last five years.)

Lastly when waiting for your passport you should ask at the counter if your passport is ready - since I spent almost an extra hour waiting as they somehow forgot to call my number!

Many congrats! I have a couple of questions:

1) How many absences did you have in total? How many were work related and how many paid vacations?

2) When you say

a) Absences from the UK - it appeared that these were checked against some records on the system.

Did the case worker actually reconcile your absence sheet with some data in his/her system line by line?

Thank you - to answer your questions:

1) 110 days all holiday/vacation.
2) Yes, I got the impression that they already have a lot of the information on their systems and they were doing detailed cross-checking that what I had put on the list was correct, I was glad that I had been meticulous in getting the information exactly correct.

I have a similar case and a doubt which you can clear....

I have a similar gap in employment and this was 69 days....

After getting my work permit transferred, I still worked for my previous employer for 3 days in UK and another month back in India to serve the notice.

After getting relieved I then came back to UK and started working with the new employer...

Does the above situation will cause an issue or will prevent me from getting ILR?

Your help on this will be greatly appreciated!!!

Is there any rule as of how many maximum days can we have in betrween employment whilst on WP (i.e. time needed for relocation etc).

I am no expert, however based on my reading and understanding of the guideline, I have the following two interpretations:

Case 1

The COS or the new work permit has a validity date of 6 months and you have to get the FLR within six months or else it become void after date of issue. So technically you have six months is my understanding.

Case 2

It should also depend on how much time is left on current work permit, so if you have only 1 month left on visa to expire you have to get this within a month....

Not sure if I have answered your question though.
