5 Years ILR Set (O) - WP / ILR

Post by man_piy » Sun Dec 25, 2011 12:59 pm

Hi,

I entered UK on a 5 year work permit on 16/08/2007 with Employer A. I left this job on 24/12/2007 & Employer B applied for my work permit in first / second week of January 2008 so that it was within 28 days of leaving my previous job ( although i dont have a document that mentions the date of application) . The application was approved on 08/02/2008 while I still had a valid leave to remain until Aug 2012.

I then got onto Tier 1 (G) in August 2009 valid until August 2012. So, I am due for my ILR / Tier 1 extension in July / August 2012. I know its a bit early but just preparing myself with the options that i have.

I have all the required documents as per the guidance notes But still have the following questions:

1. When I switched from Employer A to B, I was still waiting for Home office approval and hence couldn't work for the whole month of January 2008 and have no payslip for that period. Would this be classed as economically inactive or a gap in continuous employment ? I am just worried if this one month resest my ILR clock?

2. If the answer to above question is yes, should I first apply for Tier 1 extension and wait another few months for ILR or would it be a good idea to apply for ILR in same day premium service?

Any help on this is highly appreciated.

Thanks & Regards

MP
