Please I would sincerely appreciate any advice. I was married in the US in AUgust 2004 and obtained a spouse VISA before moving over here. My child was born in September of 2005 and has dual nationality. I often go back to see my parents in the USA and since my spouse visa was due to expire on August 19th 2006 and I was travelling the second week of September I didn't have enough time to send away my passport so I did nothing and figured I would apply when I got back to the UK. When I returned last week I was told that my spouse visa was expired but that they would grant me entry clearance probationary for 2 months. I have now gotten all of my paperwork together for ILTR but have been told that there is the possiblity that they will refuse me because I am not officially here on a spouse visa any more and because it is expired. I also have plans to travel back to the US for the last week of November (Thanksgiving) and it is urgent travel as it is the last I may see some family members. Therefore, I don't know if 7 weeks is long enough to submit the forms seeing as how they say it may take up to 14 weeks. Also I'm not a big fan of throwing 335 pounds down the drain. What are the chances I will be approved and get my passport back in time to travel? What are my alternatives? I am only in the US for a week and in Florida. The nearest spouse office is in New York to apply by person- way too far to travel, and by post I am told it could take up to 3 weeks. If I travel back will they refuse to let me in. My baby is a dual national will they let him in and not me? What should I do? Any help would be appreciated. Also my husband and I own our house here and he works here and cannot move to America.
