1. If you think that an error has been made then write to the relevant department and highlight this mistake.auntjemima wrote:hi all,
I am applying for ILR on the basis of the 10 year rule. I have been in the UK for 11 years and 3 months. I am currently on a post study work which ends on Jan 22 2012 and prior to that was on a student visa. I requested an SAR and they sent me the documents.
On the summary sheet for the case workers notes, it says that I made an out of time application in 2003. However I know that I did not and on the screen shots of my application history it shows that I made an application on the 29th of Oct - leave expired on the 31st.
It would seem that the Home Office has made a mistake and the case worker made notes based on the date the application was picked not on the day that it was submitted.
Should I point it out when I apply or should i just let it go as they might realise their error?
If i get refused on that basis, what is the appeal procedure? I am working at the moment and I do not want to lost my job if my passport comes back with a refusal on the basis of their admin error as I am sure they wont compensate me for my time and wages lost:)

2. Have u got any proof of sending the application on the 29th (u postal receipt or HO acknowledge letter for that application).
3. Did u post (Special/ recorded) u application or used the courier for delivery.
4. If by post then u did make an in-time application on the 29th.
1.Write to the relevant department and highlight this mistake and do not worry too much as u have the proof (SAR) that u made the application on time and that the caseworker made a mistake.auntjemima wrote:I did submit it in time. 1. Do both and write a cover letter explaining the situation and highlight on u SAR where the mistake is.auntjemima wrote:should i include this with my application? i wanted to apply this week as my visa expires on the 22nd of Jan or do i send it seperately?

2. Data protection team takes time to investigate and then correct it but as u need to apply now then it wud be betetr to send the letter to both (Data protection team and with u application.
3. Keep the postal receipts for both this time.
