SET O Form Version 10/2011 URGENT HSMP/Tier JR Review

Hello All,

I have some urgent queries re the new SET O Form Version 10/2011 as below: -

Here is my visa timeline. HSMP Letter Sept 06 => HSMP Visa in passport 01/02/07 => Tier 1 stamped in passport Aug 08 expires 01 Feb 2012.

Now am applying for ILR.

Page 3 - Payment details.
I have ticked the box Judicial Review as I believe I fall under it, though as a Tier 1 Migrant BUT it lists 'applying as a Highly skilled migrant'

When you select this it has a knock on effect to the other sections as follows: -

Page 7 Under SECTION B There are 2 options: - Tier 1 General under HSMP JR and Highly Skilled Migrant under JR. In theory if you tick the box on Page 3 you should selecting Highly Skilled under JR this page.

This affects page 8 - Section 4 The Life test as it only caters for the HSMP under JR review and not the Tier 1 under JR Review. From my understanding if you applying pre Nov 06 you should be exempt from the test as per the JR Policy document under the Introduction point 4.

This leads to Section 10G (Page 34) - For the Highly Skilled (5 Years) and 10L for Tier 1 (Page 35).

The forms seems to contradicts itself as if you tick HSMP on Page 3 then it should be HSMP on page 7 and Section 10G.

Though I want to make sure I don't have to take the test and what to provide to shown them this my appointment is tomorrow !!

I believe you do not need LIUK if you are covered by HSMP JR .
