tier 1 general extension

Hi
My friend has applied for tier 1 general extension but it has been refused in lag of his earnings and he has appealled it that has been refused they have given chance to appeal again,now by end jan 2012 he is completing his 5 years.
Because of five year completion is there any chance for applying ILR

Plz advice me for the next step which will be very helpful

You need to speak to an immigration lawyer since this is an appeal & even possibly change in circumstances
