I am on Tier 1, completing my 5 years on the 1st September 2012. However my Visa expires on 30th Nov, 2012. You must be wondering why there is a difference of 3 months. Actually, when I applied for extension back in August 2009, Home Office sent me an acknowledgement within a week time that my application has been received and they have charged me the fee etc. After three weeks (first week of Sept 2009), they sent all the documents back with my Passport and a letter saying that my application has been approved and the visa has been endorsed on the Passport. When I opened the Passport, I couldn't find no visa. I rang them back asking what happened there, the Home Office suggested me to send my Passport back saying it couldn't be a possible printing error. After a week of sending them the passport back, I rang them again to find the progress, they replied your application has been turned down because your Application Fee wasn't received. Cutting the long story short, I found out that my Credit Card company declined the transaction assuming it was someone dodgy was trying to take money out of my account. Anyways, I re-applied, paid fee by cheque to make sure it goes through this. Meanwhile three months lapsed, so we were in the month of Nov, 2009. I got my application approved and Visa endorsed this time.
My question is: Can I apply in month of August 2012 for ILR? As it wasn't my fault to be honest that caused 3 months delay. I really want to get it sorted in August.
