Non EEA and EEA member marriage - study/reside in France

Hi there,

I need some help. I am a Canadian admitted into a Pre-doctoral programme in France. I do not have have my VISA yet since I had an interview to get in which required me to already be in France. My girlfriend is Italian. If we marry in Italy, do I have the right to study in France?

Where is your girlfriend living? In France? If that is the case, and she is exercising Treaty Rights in France, and the two of you are married, then yes you would also have those same Treaty Rights, but would need a French-issued EEA Family Permit in your passport in order to prove it.

But is your girlfriend exercising Treaty Rights in France? If so, in what way? Studying? Working? Or what?

Assuming girlfriend is exercising Treaty Rights in France, it might be possible for the original poster to apply for French citizenship in a few years. France does give some concessions to French university graduates, and depending on French law, it may be possible to apply for citizenship holding an EEA family permit.

Alternatively, or in addition to this approach, under current Italian law (which could change) it seems to be possible to become an Italian citizen after three years marriage to an Italian, without residence in Italy.

Hi,

My girlfriend is living in Spain currently (working as a PhD student) but is planning on moving to France in January. However, it seems to me that marrying would not solve the problem if getting the "French-issued EEA Family Permit" would oblige me to go back to Canada. The question is then, can I get this 'family permit' directly from France?

It is not clear from what you have posted ... what is your immigration status in France at the current time?

I am currently in France as a tourist. I have been accepted in a M2 (pre-doctoral program). To obtain my VISA (carte de séjour) I am required to go back to Canada. In order to avoid this I'm considering marrying my long time girlfriend who is Italian but resides in Spain.

Iam new here. I am living in the US, my bfriend is french and I am non EU. We want to go to france. I have a medical degree, but I have to be french to work there. Can you tell me , what is better, to marry here or there? How long it will take for my paperwork to be done?
