3 Months Gap in UK Stay - Due for ILR

Hi All,

I came to UK on 3rd August 2007 on Company WP.
I got Tier 1 General Visa in July 2008
I got Tier 1 general Visa Extenstion in July 2011 valid till July 2013.

As per my entry Date I will be due to apply for ILR 28 Days before 3rd August 2012.

Issue:
In between my Company sent me India to work out of India Office for exact 3 months. 1st Nov 2009 - 31st Jan 2010.
So, I dont have UK Salary slips for these 3 months. Though I travelled only on 10th Nov'09 so, I was away for 81 Days from UK.

Question:
1. Is my Gap for 81 Days of 90 Days.
2. Is exact 90 Days Gap Normal/allowed?
3. If not what are my chances to get ILR
4. Please tell me if any Document need to be submitted for that gap.

Hi wahasif, I think since you have a gap of 81 days, you are definitely safe. You should show your absence in UK as 81 days, and not 90 days for that period.

And in your case since you were already on valid Tier1 visa at that time, you need not even specify that your company had sent you back for sometime.

Just ensure that your total absence does not exceed 180 days.

My overall Days out side UK are as below
Paid Holidays travelled outside UK: 67 Days
Official Travel to Europe and US: 240 Days

I have Letter from Employer for my Official Travels.
For paid Holidays I can take out Salary slips for months I travelled in.

Question
1. Does it matter if my Paid Holiday + Off Travel exceeds 180 Days?
2. What should be the purpose I should show for that 81 Days abstance.
3. What of they demand Salary slip for that 81 Days period.

Ans from me:
1. As per the guidelines the number of absences should not exceed 180. So in your case the caseworker will use his discretion. But considering other's experience, it should not be a problem. The letter you got from your employer is a big advantage

2. Since your absences are more, the caseworker may scrutinise each instance of long absence in detail, atleast you should be prepared for this. The best approach in my opinion is to get a letter from the employer saying that you were sent on an assignment, and mention the same in the form. This will definitely work

3. If you are able to do the above, it should not be a problem. And HO will never ask you to provide payslips before 15 months prior to the application

Hi all,

I am in process of completing SET (O) form but in section 6 there is no column for number of days absent. Where do we state that how many days we were absent in 1 go and total number? I am within the limit but don't know where to say that.

Also do we need to enter absences for dependent?

I tried to look into existing thread but can't find it please guide me if its already answered.
