MN1 form for kids

hi there,

Please help with 2 questions for the registration with MN1 form.

Our kids were born in UK, with UK birth certificate, holding Chinese passports, with dependant visa valid until 06/2012.

My wife and I have got ILR, via the 10 years route.

I have 2 questions as below:

1. We would like to register our kids as British Citizen before their visa expires, based on "section 1 (3)". Could we do so without they obtaining ILR first? (NB: The MN1 form has an item "1.3 Please say if and when the child was given indefinite leave to enter/remain in the UK.", so I wonder whether this is a pre-requisite for registration as citizen for UK-born kids as well.)

2. For providing the "Parents’ marriage certificate", as ours is in Chinese, does it have to use special translation and notarial offices with verification stamps, or my own translation is acceptable by UKBA?

Yes. The child immigration status is irrelevant for application under section 1(3) as this is entitlement for BC. The form says "if and when" as it needs to cover other categories of registration which might require ILR. If not applicable, just leave blank.

Your own translation is enough (marriage certificate is not really required for application under 1(3)).

As the MN1 guide clearly says "AND parents marriage certificate", I will still translate and send it to be safe.
