I applied for 10 years stay ILR, but for rejected for a Visa gap between 31th August 2004 to 12th November. I entered UK on 17th August 2001 with a student visa to study in High School. I have been studying with a student visa ever since (Bachelor, Masters and Phd). On 17th October 2008, I applied for Post-Study Visa for my stay untill the start of my Phd in January 2009. The only gap in my residence is between 31st August 2004 and 12th November 2004. My student visa expired on 31st August 2004 while I was waiting for my A-Level results. I can not return home (Taiwan) as the law in my country states that if we are not a student after 18 we will be obligated to do a one year national service. Therefore I had to stay in the UK until I obtain my student admission letter. After I entered university I recall I made a mistake in my payment. This caused my application to delay in October 2004 which is why my application was proceeded in 14th November 2004 (In the official home office document, it stated my application was rejected in October 2004 without stating why, but I remember it was because of the payment problem.).
It is stated in the rejection letter that I can not appeal as my current visa is valid until May 2013. However, I just wonder if there is anything I can do to overturn the rejection for my gap in 2004? I have always been a person of good character as all my British friends can testify. During my study I have volunteer to teach Maths at a school and adviser for overseas student and other things. My field has many applications in technology such as IT and Engineering which is useful for the job market. It is very furstrating as I have made plans to build my career in the UK and all my social contacts are here. I would be very grateful for any advices you might have.
