Question about Points Table

Post by vivekmang » Sat Jan 14, 2012 1:18 am

I found the TIER1 guidance on the points really confusing..

On page 10 of the guidance (http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf)
there is points calculation for one category of applicants defined as
<<
Points tables
Applications for leave to remain where the applicant has, or last had, leave as a Highly
Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1
(General) Migrant under the rules in place before 6 April 2010 and has not been granted
leave in any category other than these since 6 April 2010
>>

whereas on page 11 there is a another points table for the rest of the applicants who do not fall in the category of page 10

The category on Page 10 includes all the applications for LTR where applicant had leave as TIER 1 (General) under rules in place before 6 April 2010 and not been granted leave in any category other than these since 6 April 2010

The date of my TIER1 VISA application was 22 December 2011. Do I fall under the category of Page 10 (OR will I be considered under the rest) ?

Can anybody here offer any insight ?

If you applied in December 2011 there is no way that you could have made your application under the rules in place before 6 April 2010, therefore, you do not fall in the category on page 10. Therefore, use page 11. You definitely cannot fall under the rules before 6 April 2010 so I'm not sure why this is confusing?
