fresh application when waiting for appeal decision

hi
one of my friend made an application before his visa expires, but there was no CAS because of language test, and they send him a refusal decision, he made applications for appeal and hearing done, now waiting for decision so is there any options for a fresh application.

1. If there was no CAS then why did he apply in the first place as he shud be aware off that application will be rejected.
2. Lets say u make a fresh application so hav u got a CAS now.

1. he send his application with a cover letter, and that was...like as soon as possible i will send my CAS with english test result. he get time but when he get result and CAS he just receive his refusal letter.

2. yes he has CAS now.

1. Cover letter wud not work as application to be valid CAS needs to be mentioned on the letter.
2. Why not get sum advice from your college regarding this issue.
