When to assign CoS?

When to assign CoS?

Hi All,

I wish to Switch from PSW to TIE2 general in January and here is my current situation -

Company and COS
Type: A-rated, Tier 2 Licensed
Allocation: Additional allocation requested and recieved in October ( not yet assigned to me)

My Info
Current Visa status - PSW ;
Expiring on 27/12/2012
Current Job : Online Marketing consultant in London,
Salary : £26+,
SOC (tentative) : 3543 (£11.01 per hour , works out to be about £21K)
Job start Date : 20/07/2011.

My questions -
1. Am I ok salary wise ?
2. Since I complete my six months only on 19th of January to qualify to claim points for switching from PSW, can my employer assign this CoS before that or do we need to wait till 19th January?
3. I intend to send my application by post on 23rd January by first class however my PSW runs out on 27th. Is this an issue in anyway?
4. In case I might not have the 6th month salary slip (since middle of January). are there any alternatives.

I would really appreciate your help on these questions.

Are you working for 37.5 hours? if not, you need to pro-rate your salary to 37.5 hours and see if you satisfy hourly rate
2. Since I complete my six months only on 19th of January to qualify to claim points for switching from PSW, can my employer assign this CoS before that or do we need to wait till 19th January?
COS must be assigned AFTER you have worked for 6 months

3. I intend to send my application by post on 23rd January by first class however my PSW runs out on 27th. Is this an issue in anyway?
Date of postage is the date of submission of app, if sent by Royal Mail. so yes, you are ok
4. In case I might not have the 6th month salary slip (since middle of January). are there any alternatives.
Read policy guidance and you will have your answer!, short answer is, yes, there is an alternative

I would really appreciate your help on these questions.

Hi Arsenal,

Thank you so much for the reply. I just wish to point out that I made a slight error in my message..my visa runs out on 27/01/2012 and not 27/12/2012.

Yes I work 37.5 but don't really know how to Pro-rata it. My salary is £26+.

Total number of working hours ( annual) - 37.5 x 52 = 1950
Salary per hour = 26000/1950 = £13.33
Requirement for SOC 3543: £11.01.

Am I doing this right?

Now, i also wanted to clarify that am I thinking right by calculating 6 months between 20/07/2012 and 20/01/2012. Or would the case worker only start counting my months from 1st of August?...Should I be bothered about this? or I am fine.

Is the alternative to salary slip is the letter from employer or am I missing something here.

if you are working 37.5 hours... you dont need to pro-rate!

your salary is fine.

read the policy guidance about alternatives to the salary slips.

if the letter from employer mentions dates as well as explicitly say you have been working for more than 6 months, than it should be OK...

Urgent Help needed

Hi Arsenal,

Going back on my question about when to Assign.

I just got an update from solicitor who has assigned the CoS today which is the 18th of January. However, I complete six months on 19th of January.

He says that because the start date on the CoS will be 27th of January, hence it should be fine to qualify.

I am really getting confused here. Need help urgent.

I think your solicitor is right.

Also make sure he is a level1 user to access the SMS. Otherwise its a breach of your license.
