Access Rights to a child

Post by kbobo » Fri Jan 20, 2012 2:05 pm

hi guys, i have heard a lot of good things about this place so i thought i come here for help

I am married to a british citizen and we have a 2 year old, am currently on a spouse visa which has got a year left, we are seperated and going to go through a divorce but i wanted to know if i can apply for access rights to remain in the uk because of my baby.

I know there is either the option to extend my visa or apply for ILR right?
Can any1 please post any links i do abit of research or reading on the matter, i know i cant go for ILR due to a criminal record i have to wait for it to be spent first but can i extend a spouse visa to an access right to remain once its expires?

Will i need a court order for this application or will a letter from the mother ok to make this application.,

Thanks in advance

Thanks for that, lots of good info

Can I ask tho, wen the divorce is finallised, will I hv a legal status in the uk? Cuz am sure I will still hv sumtime left on my spouse visa.

Will I hv to apply straight after the divorce? Or wait to nearer the end ov my spouse visa?

Thanks in advance

You need to apply as soon as possible. Don't wait until nearer the end of your spouse visa as it could be curtailed.
