ILR ?

hi,

Firstly i am sorry to post this topic over here as i have posted this on the imigration for family category but havent had a response hence posting here. extremely sorry for this but just need this to be clarified as i need to start porcessing the visa ASAP.

i recently obtained my ilr in jan 2012. (i was on hsmp + tier 1 not converred by JR)

my wife got her tier 1 dependant visa in Feb 2010 and came to the uk in Feb 2010. she was with me till july 2011. her visa runs oout in feb 2012. and then went back home for maternity. now we are blessed with a baby girl . Now how do i bring my wife and baby to the UK. do they need ILR dependant visa ? (is this know as spouse visa - if so what visa is it for child) if so what are the dcouments needed and how much is the fee for it in India ? (since my wife stayed with me in the uk for about 16 months will this count towards her ILR or does the 2 years have to start once she is back in the UK on ILR dependant visa ? )

or is there a chance i can apply for ILR dependant now in India for her ?

Wife may apply for a spouse visa.
Child may apply for a child settlement visa.

In answer to the last part of your post, no, the time spent by your wife as your Tier 1 dependent will not count towards her ILR.

can the child apply for settlement visa? which means she does not have to apply for visa after two years as my wife has to? wo hoo thats good news !!! (how is this possible as the child was born before i got my ILR ?

can ou please provide me the doucments (even a link on this forums would do ) needed for both and do you know how much would be the fees also?

Please read the links Vinny has sent you. No, your son does not qualify for settlement as your wife is not also settled. He will be given a 27 month visa the same as your wife. It is referred to as a 'settlement' visa because it is a visa that is granted with a view to settlement.

ohhh sorry just got excited for a moment. so its two different application forms i need, isnt it or can i use the same VAF4 form ? and after 2 years i can get both converted to ILR, is it ?

does any one have the cost to apply from india and also documents needed (even a link on this forums would be helpfull)

there are numerous posts on the forums regarding the documents needed for spouse/child settlement visas.

if you took the time to actually read the information in the links provided you would find the answer to this question. Each applicant has a separate form, and pays a separate fee.

greenie, i am confused here.

the vaf4a says its for spouse / children

VAF4A application form - partners, children and other family of UK citizens or settled persons (settlement)

So i am confused. if its a different form for child could you mention what form it is ?

so rather than spending the time using the search function yourself, you want someone else to do it for you? A significant number of the posts in the immigration for family members section of the forum are about this issue. Please have a look for yourself.

do i have to get my passport attested ? if so i have new passport where my ILR is stamped and my old passport where my tier 1 is stamped. does both passport need attested ?

also can i get the attestaion from Indian high commission in the UK as its expensive to get the attestion from solictors
