tier 1 general withdrawal

tier 1 general withdrawal

Hi, I have dropped my application just before they stopped tier 1 on April 2011. I have sent my Bank statements in separate post and got misplaced by home office and they have rejected my application. I went for an appeal on Aug 2011, still haven't received any reply back, I am saturated and giving a thought of withdrawing and go back for good.

My PSW visa got expired on 19th DEC 2011, What happens if I would like to book a ticket will I be questioned for my overstay?

any suggestions what to do If i want to leave country without any hassle for not getting any bad remark on my passport?

Until ukba gives u any decision ur visa status reverts back to Last permit i.e PSW in ur case. At the moment ur special delivery number, the UKBA receipt confirmation letter etc are proof that u havent overstayed bcuz of above reason. Finally legally UKBA expects visa expired persons to leave within a certain period of time voluntarily after the date of visa expiry- 3 months but not sure 100% about the number of months.

So u should be fine as u havent overstayed as Ukba hasnt given u any decision. Also ur employer should accept special delivery number or Ukba receipt letter as proof of work permit until ukba's reply.


Also if u overstayed ur visa lets say 1 yr and left uk nothing gonna happen if u did it voluntarily and were not chased/ caught by ukba officers

thank you for your reply I have made a decision to withdraw it and go with in a months time, your reply had given me a lot of confidence, Appriciate your effort and time in answering my query.

Naveen have you followed up on the status of your appeal with UKBA, given the appeal was in August 2011?
