Pakistani wife applying for ILR help needed please

Hi All,

i just need some help on applying for ILR for my wife,
she came to the UK in March 2010, so in March 2012 her 2 years for the spouse visa finish, therefore we have to apply for the ILR,

i just want to know what doucments i need to do this and how i go about doing this? i am a British citizen and my wife from Pakistan, any other questions please let me know.

Have a look at Set M application form, it will explain most of the documents needed. Any document sent to you, your wife or with joint names at the same address will do, they must be spread over two years ( since she came to UK). I hope that helps

Has your wife passed the Life in the UK Test or completed an approved ESOL test?

hi she has an essol level 1 certificate, and on going at college, is that ok? also in terms of finance apart from my current account, can i supply my saving account information too?as my current account doesnt have much saving in it!

Submit both savings and bank statement. Your wife will need to provide a letter from the college confirming that she has progressed from one ESOL level to the next and that the course has contained Citizens material.
By the way, case workers are instructed not to refuse a spouse ILR application due to lack of finances alone. The focus is on whether the marriage is subsisting and you a still living together.

Ok that's excellent, i managed to get a template letter from the set m notes, we also have a child together, do I need to put my little one on there too, or do I just supply her birth certificate?

Also I'm I allowed to claim
Child tax and working tax credit or would this be seen as claimg public funds?

The child tax and working tax credit must be claimed in joint names...which won't affect the ILR application.
You don't need to include you child in the application. Your child is British.

Hi there,

I am in the same position however I have some questions. I am a graduate and had a good job before leaving in August due to non development.

In looking for a new job I have had no luck so after 2 months of not doing anything I started doing p/t taxis at the end of November early December.

My wifes ILR will be required to be completed by Mar 2012. I have instructed an Accountant and am declaring a weekly earning of £220.00 per week gross.

Will this be enough earnings firstly and due to the short time I have been doing this work will I have sufficient wage slips / accounts.

We also have a child born here and am receiving tax credit and benefit. does this need to bestipulated on the form.

We also live with my parents who supported our 1st application of living with them for as long as we like. I have sufficient letters together etc for the application.

Any help will be much appreciated

As regards SET(M) applications, case workers dealing with such applications are instructed not to refuse such applications simply because of financial reasons.

So as long as your wife has passed the Life in the UK test, and all the correct evidence is supplied, there will be no reason to refuse the application.

In regards to my original question, that my wife came on the 3rd march 2010, so therefore her 2 years expires in 3rd march 2012?

On her passport I have just seen the visa part, in which it says entry clearance, valid from 21/01/2010 then it says valid until 21/04/2012,

I am therefore confused now, in regards to apply for her ILR, do I apply for it 28 days before the 3rd march 2012? As that is when she entered the uk? Or do I go off the visa expiry date of 21/04/12? And apply 28 days before 21/04/2012?

Any help would be appreciated

28 days before 3 March 2012 to when the visa expires is ok, the earlier the better

zoomaj, chrisrich is right, and spelling out the dates, the ILR can be applied for no earlier than 28 days before the 2nd anniversary of the first arrival in the UK on the spouse visa = 04.02.12 ..... and no later than the expiry date of the current visa = 21.04.12.

The usual length for spouse visa is 27 months within the expiry of main applicants visa and the dates in your case seems just fine .... But the 2 years residence counts from the date your wife entered UK, hence you can apply 28days prior to 3rd march 2012.

That is true if the spouse visa is issued outside the UK. However if the spouse visa is issued in the UK, for example on the conversion of a fiancé(e) visa to a spouse visa, then its duration is two years.

Thank you for your help, this is turning out to be an excellent thread and I hope it helps other people too,

I have just thought of another question, the 6 letters we have to submit to show that we are living together need to range from the 2 years that's my wife has been here in the UK right?

Although she came in march 2010, it takes a while to get a few things in her name, so my first letter with her name on actually started in August 2010, so I have letters from August 2010 till now, from different sources, however there is a 4 month gap at the beginning, could this cause a problem??

Indeed, and UKBA are obviously aware of that. Did it take 4 months to get her NHS card?

In regards to the financial situation they are asking for the last 3 months, I have got bank statements for that, in regards to my payslips will also have to show them too? Our company has switched to epay, so I have printed out my payslips at work ,would I need to get these certified? Or the print outs I have got will they be sufficient?

Provide the payslips as well, i think they are ok if they show the company's name but get them certified if you can.
