This is on behalf of my brother

He bascially got 3 points on his license in court in 2009 for not driving according to license, meaning all he had was a provisional license, with no L plate and no guidance.

He was born here but our parents did not have ILR at the time, my mum was just given ILR in 2008, we all got it too. I had no problems applying for my naturalisation in 2010 and also got my BP.

We have both been reading a lot of topics on here about whether or not he should declare it because there was a person on here that declared theirs and did not get it and there have been people that didnt declare it and still got their naturalisation but another guy that did not declaire his got declined and has to wait a further 10years now for not declaring it on his form.

We would like some advice please

I think you summed up well all the information.
If he was convicted by court then it should be declared in his application up to 5 years after the conviction (BTW - there was no fine?).
Can he get away with it by not declaring? Perhaps but you can also get away with any crime or cheat.
What do you expect people here to tell you?

I wasnt expecting anything, like most people that post on here, just everyone's views.

He had a fine, conviction was given in court and he paid his fine.
