Changing child's Tier 1 dependant visa

Post by goingbrit » Thu Feb 02, 2012 1:26 pm

Hello everyone and thanks in advance for your help!

Does anyone know if it's possible to change my son's status from being my husband's Tier 1 dependant to being mine (I also have a Tier 1 visa independent of my husband's). We are in the UK and will be renewing out Tier 1's in August.

The main reason for wanting to do this is (i) so that I don't have any issues if I travel alone with my son (not sure if main visa holder has to always travel with child dependant) and (ii) my husband's ILR situation in 2 years might be complicated as he travels a lot for work, so I would like to apply for my ILR separately along with my son.

Thanks!

Thanks, Greenie! So essentially I will fill out the usual dependant info for the little one along with my extension form rather than my husband's?

As far as i know there is no such rule that the main visa holder has to travel with the dependent, even if its a child.

As long as whoever is traveling has a valid visa it should be fine
