ILR - more than 90 days at one time

Post by chetan1279 » Tue Feb 14, 2012 9:55 pm

Hi, I have been in the UK on HSMP and then Tier 1. My visa are due on 23 March 2012 and also completing 5 years. However, during this period I have been outside the UK for 100 days at a time between 02/04/2007 to 11/07/2007. Apart from that there isa no other absence outside the UK.

Shall I apply for ILR as during those 90 days I was ill and delayed in returning back. Do case worker consider the illness? Would be preferable to go to PEO and explain the case to case worker? OR

on the safer side, extend Tier 1 visa and apply in July 2012?

Please help and I am confused at the moment. If ILR get rejected after my visa expiry date then there won't be any option left but if apply for extnsion now will be the safest way. Anyone gone through similar cicumstnces, please advise.

Thank you.

My recommendation is to apply for an extention Tier 1 visa and then apply fir ILR in July 2012
