Hi All, need some thoughts about my case as am getting anxious.
I am applying for ILR with 3years WP and 2 years Tier 1 2007-2012. My question relates to the time spent as WP holder, I remained with the same employer throughout the 5 years but my concern is a change in job in 2008 before the birth of tier 2. At the time, my employer stated that a new work permit is not needed as I am staying with same sponsor, changing to a job within the same SOC and both job of shortage but with salary increase. Basically change in title but no change in core duties.
The current rules for tier 2 are very clear, so as per current rule, a fresh application was not needed. But I cant find anything to confirm the rules back in WP days. My main concern is that the HO may question the salary increase (which was over 30% of that stated on my wp in the years leading to my tier 1 in 2010). Will this be seen as non compliance with my wp.
Note that when I have applied to tier 1, my salary was substantially more than the wp but the home office granted me tier 1 without any questions.
To sum my questions:
1) Did my job change require a new wp (at the time), can they reject ILR on that basis
2) What documents shall I take to the HO to cover the wp days P60? employer letter to cover that period specifically?
3)do i need to declare the job change if it is within same SOC?
