ILR application while unemployed and on Tier 1 (General)

Hi,

I am currently on Tier 1 (general) and would like to apply for ILR as I will have been in working in the UK for 5 years in March 2012 (on a combination of work permit, and Tier 1 (General) visas)

While I still have the required points to qualify for Tier 1, I am not currently working and haven't been since Dec 2011.

Does the fact that I am not currently working prevent me from getting ILR (even if my income for the past 12 months are over £40k)?

Note: Although I am not currently working, I could
- live off my savings (I have enough to live off for over 1 year), or
- I could pay myself from my Limited Company (even though it is not earning any revenue).
Would doing this help with satisfying the Financial requirements in section 5 of SET(o)?

I dont think its a requirement to be employed at the time of your application if you can score the income points needed you will be OK,
I am going to submit my last 7 months salary Stuff which will be enough to score income points I need to qualify for ilr.
But be patient some one more senior will be able to reply in details.

As long as you meet the point requirements you are fine - you don't need to be employed during the time of application or even in continuous employment during the period.

If you can pay yourself a salary i.e. If your company has reserves to pay your salary you are still technically employed.
pay yourself a salary and produce evidence of the same.
