ILR for Non EEA citizen after divorce?

Post by Jespar » Tue Feb 21, 2012 1:40 pm

Hi.

I got married to a British national in 2003, applied and was granted my ILR in 2005. We are now divorcing and should be getting my decree absolute soon. I do not want to apply for a UK passport as I intend to keep my US citizenship. I have been working in the UK since 2004 and plan to stay as I have a new partner. I do not exceed the amounts of time allowed outside of the UK. My current ILR is a sticker in my passport which will expire in 2014. If I enter into the UK I use the "visas" lane and am asked why I have ILR, which says "spouse" on my passport. I can't find anywhere that tells me who I need to notify or what I need to do to. Can anyone help?

you don't need to notify anyone. when your passport expires you can have the ILR stamp transferred to your new passport (or they may issue you a biometric residence permit) or you can carry your old passport and new one.

The UK permits dual citizenship (and I understand the US do too) therefore you would not lose your US citizenship should you apply for British Citizenship.
