Family visitor visa

Post by Akoor » Wed Feb 22, 2012 9:34 am

Hello there,
I do have a question about immigration rules. I am on a visitor C4 multi entry visit visa valid for 2 years, I am a spousal (husband) of a full time international student. She has a student visitor English language visa.
The thing is my wife's course is longer than 6 months, and as far as I know I can not stay in the country for more than 6 months. So my question is can I apply for any sort of extension? And if not, is it possible to transfer my visit visa to a family visitor visa while I am in UK?
I am in UK since January 2012 and I believe I should leave on the 1st of July. But my wife's course will finish on the 15th of august. :( :( :( :( :(

Can I apply for any sort of extension? .............No, not in your circumstances.

Is it possible to transfer my visit visa to a family visitor visa while I am in UK?............No, and if you applied from outside the UK, it's not likely you would be issued a new visa in the family category as you will have already had six months entry under the visit category. Generally (with some exceptions), all visit leave is aggregated to a ceiling of six months in a twelve month cycle and it's not permitted to be a general visitor for six months and then be a family visitor for another six months immediately following.

So there is no way to stay with my wife until she finish the course? What if I left UK before the 6 month permission to stay, in that case can I apply for a family visa?

You already have a visit visa that is valid for two years so there is really no point in applying for another visit visa which, in any case, would not permit you to return to the UK where you have previously spent six months in a given year. Your partner has an exceptional category visit visa that permits entry for an extended period that is longer than six months, whereas your type of visa does not.

You could try leaving and re-entering but your admission would be at the complete discretion of the Border Force official based on the quality of the answers you give to questions about your reason for returning so soon and the length of time you have previously spent and wish to spend further. It seems you don't wish to visit the UK but that you wish to continue living there while your partner completes a course of study. Not a valid reason to visit but you may be lucky and be admitted!
