180 days in stretch - please help

Hi All,

I'm a silent reader of this forum.

I'm on HSMP and Tier 1 General and ilr due in august 2012.

I have gap of 6 month. I went back to home country to do some professional courses as i was not getting good job.

so my questions are :

in this scenerio what should i do ?

can you refer any immigration solicitor who can help ?


I have read all the post no where i can find case similar to my one. every one who stay > 90 days was only employer sent them etc.

i dont know what to do .. may be some of you can help.

i really appreciate your sincere reply or advices .

6 months gap is a huge concern especially when you are not paid for your absences out of UK

With regards to solicitors, there are many of them, just google and you can find out. As you have sufficient time, you can decide which application is best for you, either ILR or a further extension on Tier-1

thanks santosh but if i go for FLR my ilr will be due in 2015 which i dont want and as you know changes of ILR comming up if i stuck then ???

Could you mention your visa issue date, arrival date, extension and the 6 month gap date(s).

Because your 5-year period starts from the date you entered UK after the 6-months gap

dates are

hsmp september 2007
tier 1 ext - september 2009
ilr due august 2012

6 months absence from may 2010 to october 2010

Since you have gap of 6-months without any favourable reason, it seems like your clock sets back to Oct 2010 as your initial entry. That means you will be eligible for ILR in Oct 2015.

As you are not interested for ILR in Oct 2015, you can give a go for ILR in Aug 2012 but as far as I know there is too little chance. Moreover you will be wasting the money as well.

But, if you can atleast provide evidences of strong ties with UK during your absence by providing any council tax bills, any insurances like car insurance, telephone bills, rent (or mortgage) paid during your absence away from UK, it might help your ILR application in Aug 2012 if you chose to apply ILR directly without FLR.

If money is not an issue, I would recommend you to apply for FLR initially and once you get the visa you can try for ILR. Even if they refuse your ILR, atleast you will be better off with your FLR.

I strongly suggest you see a good immigration solicitor.

thanks for the brief reply. I met couple of free advice solicitor as i didnt paid any thing one said give me 3000 pounds i will do it. no budy is taking serious.

i met today one solicitor and spent 2 1/2 hour he also said there is nothing he can do . he said he will talk to barrisitor to see what can be done for that i have to pay 150 pounds for barrasitor i said i will tell you tomorrow. i'm going to see one more solicitor tomorrow let see what he say.

i can show my cinema card, credit card direct debts. my phone broadband and tv bills were continued to pay . i can show these ties.

i was thinkign the same tht apply flr then try ilr but if they say ur ILR clock reset you cannot apply ILR then i will losse money.
let me have a thought and let see whats the outcome.
