Question regading ILR (work permit)

Hi,

My work permit is valid upto oct 2012 and my current leave to remain untill jan 2013.

When should I apply for my ILT in spetember 2012 or december 2012

I started working 1 Nov 2007.

When did you enter the UK as a work permit holder? You count 5years from that date...so for example if you arrived the same day you started work, 1st of November 2007 you complete 5 years on 1st of Nov 2012 and you can apply 28days before that date. When will your WP expire? Do you have an exact date?

I came to Uk(as WP holder ) in October 2007, started working on 1nov 2007.
I had called UK home office regarding my querry. They said I should apply in September as my WP expires on 3rd Oct2012).
But my office HR is saying that as ILR is related with permission to remain in the country I should apply in dec 2012( as my current leave to remain is till 13 Jan 2013)
Thats why i am confused.

You can apply up to 28 days before the 5th anniversary of the date of your arrival in the UK or anytime after that date while your leave remains valid. So, Sept is the earliest (you can work out the actual date when you become eligible for yourself!) and January 2013 is the latest.

The work permit was valid for 60months from 3rd oct 2007

You do realise that, to qualify for ILR, you employer will have to provide you with a letter stating that you are still required? Have they agreed to give you this?

(iii) he is still required for the employment in question, as certified by his employer; and

Date of work permit issue 03/2007 (valid up to 60months)

Date of expiry of current leave to remain 3/01/2013
(limited leave to remain)


Date of staring work 01/11/2007

First Entry into country –student visa 10/10/2006

First Entry into country after obtaining work permit 29/10/2007


When shall I apply for Indefiante leave to remain?

so if I understand correctly, validity of your work permit refers to the duration mentioned in the work permit approval letter and not the validity of the actual visa. In that case, duration as mentioned in the WP letter has no relevance with your ILR.

you can apply 28 days prior to 29/10/2012

I am asking this because, on the ILR form, there is a question "whether you recieve financial assistance from family member".

In my view this is not a case of recieving financial assistance, it is just that we have ajoint account.
