Post by mr khan » Tue Feb 28, 2012 4:58 pm

hi can someone help me. my wife is applying for her spouse visa in cairo and as the sponsor i sent her all the supporting documents.

with all my other documents I sent 3 months bank statements and 3 months wage slips, plus also a housing inspection report.

out of the 3 months bank statements and 3 wage slips one wage slip and one bank statement has gone past out of the 1 month out of the 3 month period so i will need to send another lot or can i just submit what wife has got

A spouse visa is the common vernacular for a settlement visa for the partner of person who is settled in the UK. The 3 month maintenance requirement does not apply to this immigration category and any statements merely have to be recent. Do you mean spouse visa (as described) or are you a PBS migrant who is a applying for a dependant under the points-based system, where the 3 month maintenance requirement does apply?

My bank statements run from the 23rd october until 24th of jan and i wanted to apply for the spouse visa some time this week but now the date is over the 23rd of febuary . Now this is recent to what i have sent my wife and my bank hasnt sent my new bank statement yet does this mean i would have to wait till i get the new bank statement and send it to her or can i just submit to what i have got. Im thinking if i do this i will also need to send another wageslip as well.

also how long can a property maintenance report last for is it 3 months because the one i sent was given on the 24th of jan do you think i should make a new one.

Also in the time after submitting the application and documents if i was to lose my job would that get the application refused when they call my work place to check on my status.

thanks

What is your immigration status in the UK? If you have ILR you can ignore the PBS maintenance rules which you seem to be citing here.

I have a similar question.. I will be applying for a settlement visa soon however I will be in pakistan with my wife when we apply, the statements I take with me could be dated 4 - 6 weeks before the appointment date. Will this be an issue?

Thanks

thanks for the response... I agree 4-6 weeks should be ok in that case... I can't see them using something like this to reject a case.

Mr Khan

You are applying for a spouse visa and hence you will need at least 3-6 months bank statements to show the state of your funds etc. Ideally the last bank statement should be around 4 weeks old when your wife applies.

The link that you have posted below is INCORECT for the type of visa that we are discussing in this post.

The form in the link is what you will be required to do in two years time after your wife has obtained her visa and lived in the UK for 2 yrs.

The next stage is to apply for ILR and the form in the link is what you will be required to use when applying for it.

Hope that clears things up for you and answers your query

You should try and submit the most recent 3-6 months worth of bank statements, and also wage slips.

However you can submit the whatever you have, but that decision will be yours to take and the risk associated with it, it does not mean you will get refused, but its in your interest to comply with what is recommended in these forums and the rules of UKBA.

As for your work, if you leave and UKBA may call up and check at your workplace, you can notify your old work placeto tell them your new work place details if you move into a new job. If you have no employment and weak savings/assets then you are lessening your chances or will proberly result in a refusal.
