I have been granted ILR (Feb 12) and want to find out under what form to apply for extension for my Husband. We were both students when we got married 8 yrs ago and for 7 yrs he became a dependent on my student visa which was later changed to Work Permit and later to Tier 2 Migrant worker. Based on the fact that he has been a spouse on my visa for 7yrs can we apply for settlement as a spouse of someone settled here on SET(m)

He may choose to switch to FLR(M) before he travels or before his leave expires.

He should switch on form FLR(M ) as soon as possible after which he can apply for ilr on form SET(M) citing para 287(a)(i)(d )

Thanks Vinny and Greenie for the reply,
have red the section suggested, however i thought since he has been granted a visa as a dependant spouse in another category inthis case which is from student to work permit holder for 7 yrs, he satisfies that two yr requirement and so can go straight to SETm.

i know uu advised FLRm but what do u think of this? is it possible?

it is not possible to apply directly for SET(M) as your spouse does not satisfy any of the requirements of para 287(a)(i)(a-f) as he doesn't have leave in any of the relevent categories listed in these paragraphs, he has to switch on FLR(M) first as advised. If you are unsure, seek advice from a solicitor.
