Tier 1(General) - Late Entry by 15 months and complications

Tier 1(General) - Late Entry by 15 months and complications

I got my Tier 1 (General) Visa approved and it is valid from June 04, 2010 and Valid till June 04 2012.
I reside in Switzerland and hence travelled 4/5 times to London on tier 1 Visa but never stayed more than 2-3 days.
First travel date was 1 July, 2010. I got few job offers but didnt consider them.

I want to get into UK in September 2011 with a job. My questions are the following

1. During First extension of my first UK Tier 1 visa on June 2012 - i need to show last 12 months salary.
Can I show May - August 2011 salary of Switzerland and September 2011 to May 2012 salary of UK ? Is UK Tax and NI for some minimum months required for this extension ?
I understand no upliflment factor wil be applicable for me.


2. Regarding future extension (2nd extension June 2015) as I will not meet the 5 year stay for permanent residency after my first extension,
does the same rule apply which was extant for me during my first application ?

3. I am going to process my dependent spouse and Child visa after I enter UK in spetember 2011. Can I show my swiss
bank account for the purpose of maintenance account for dependent visa application from UK also ? My dependent spouse and child will process the
application from India.

4. If is mandatory to stay and pay taxes, NI for some mimimum months in UK. In case I do not find a good job in
UK by september I still want to come to UK for my Tier 1 (general) extension. If it possible to come during
May 2012 and go for an express same day application ? Is NI number and rented address in UK mandatory for extensions ?
By point calculation I will be eligible for extension.

1- Yes you can show your overseas earnings along with UK salary. However to qualify for 5 UK experiance points, you UK earnings must meet the minimum thresold of £25,000.

2- Rules at the time of your initial application will be appliable whenever you apply for extnesion.

4- There is no mandatory requirement to pay NI and taxes if your havn't worked in UK. However with the grant of tier 1 general visa, an applicant commits to work in UK for the duration of the visa and to permanently settle down. However this could go against you when applying for extension.

That means taxes or NI paid in uk less than 12 months will
Not be an issue? I will be able to get an extension with
6 months of uk and 6 months of Swiss income.

Please confirm. Is there somebody in this forum who has done this before ?


This is very important for me as I am going to travel to uk
On the basis of this advice. Thanks for invaluable help in advance.

Tania,

There are some people who got it with overseas earnings (all of it) - search forum. However the real problems are -

1) At the port of entry, the immigration office will question your motive to enter UK. You need to tell him that you want to live and work in UK. Because that is the condition for Tier 1 visa. If you state any other purpose (eg. tourism), the officer can refuse you entry.

2) The uncertainty associated with Tier 1 extension processing times. It could take even 14 weeks. Do you have that much leave ?

1. During First extension of my first UK Tier 1 visa on June 2012 - i need to show last 12 months salary.
Can I show Foreign salary of Switzerland for this extension purpose ? Is UK Tax and NI for some minimum months required for this extension ?
