On Deputation to India

Post by avbrao » Sun Feb 21, 2010 1:02 pm

Hello All,

I have recently got extension to my tier 1 visa. My company requested me to go onsite to supplier's place in India to support offshore team there for couple of years and I accepted it. Now I am in India and frequently travelling to UK based on business needs. I am just wondering wether I would be eligible for futher extensions or ILR if I wanted to do it in future. My current visa is valid till Aug 2012. I am getting paid in UK and I am paying all the tax and NI in UK itself.

Any comments or suggestion are highly appreciated.

Thanks,
avbrao.

As you are paid in UK n pay taxes, you will be ok for extension but u also need to think about ILR

Deputation In India

Post by avbrao » Mon Feb 27, 2012 7:31 am

This is in continuation to my earlier post as my tier 1 extension is due very soon (Aug 2012). I am in UK from Feb 2008 – Dec 2009 on HSMP visa. I got my first Tier 1 General extension in Aug 2009 for three years. After getting extension, my company asked me to travel to India to support our supplier’s activities. I am in India for 2 yrs 3 months now and may continue for some more time. I have to comeback to UK once my deputation is complete or whenever company decides to call me back.

I was getting paid in UK until 31st January 2012 and Transferred my roles to one of our companies branch in India (from 01st Feb 2012) to simplify the taxation issues. From this month onwards, I will be paid in India. I still remain a permanent employee of a UK company and contractually transferred to India on business.

I hope my current situation is clear from above. I want to travel back to UK for my visa extension. My company agreed for me to travel to UK for three/four months and apply for an extension. Will there be any problem if I comeback to UK for four months (April-July) and apply for extension? I am not worried about ILR at this stage but definitely want to apply for extension to keep myself in a safe position if my company ask me to comeback after visa expiry (off course they are ready to process Tier 2 in that case)

Any response in this regard will be greatly appreciated.
Thanks in advance,
Avbrao.
