Hi all, has anyone applied for PR based on been in a durable relationship with a EEA national for 5 yrs but got married less than 5 years and also holding RC for less than 5 yrs but they are still married and living together and exercising treaty right(both of them) or at least EEA throughout 5 yrs and continuing.
Anyone had this experience.
Any idea and opinion or information will help, many thanks
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.
PR dated 05/03/2013

your married must be 5yrs before you can applied for PR or when your RC is 5yrs oid

Thanks mate but before I applied for PR and they repeat that as long as u been together 5 yrs and EEA exercising treaty right then is fine u dont have to be married or holding ur RC for 5 yrs.
Different HO staff said the same.
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.

do you get married in UK if yes than 5years after the married that is if your weeding is 6/6/2007 you can appiled for PR on 7/6/2012.

Yeh married in UK but on 11/2008 and got my RC 07/2009 so its only 3yrs from marriage and less than 3 yrs but we lived together just over 2 yrs, I guess my application will be refused.
Applied for EEA4 on 24/02/2012.

So how about if my wife(EEA national) apply for BC(she is eligible) and can I apply too after she gets her BC.
As if u(non EEA) r a member or married to BC for 3yrs u can apply for PR or in 4yrs u can apply for BC.
Am I right?

If you applied for a Residence card as a durable partner, and then subsequently got married, then i believe it will be reasonable to assume you clock start clicking from the day the application was received at the Home Office. This is also subject to the application subsequently being approved.

CS Brazil

You wife having a BC can have no impact on you ability to secure PR. It may only have an effect on a Naturalisation application.

I married on 11/08 but got my RC on 07/2009 but i guess I can apply for PR on 11/2014 as 5 yrs from marriage right? I dont have to wait for RC to end.

My wife is willing to apply for British now(she is eligible) if when she get British allows me(make me eligible) for PR regardless marriage(don't have to wait for 11/2014).......guys can you advice me plz.

Your question has already been answered in your previous post.

Same goes to your questions about eligibility for PR - which was answered here.

I understand you are worried but asking the same questions again won't change things. I suggest you wait until a decision is made by the HO.
