Divorced and remarrying - spousal visa advice please

Divorced and remarrying - spousal visa advice please

Hi

Hoping someone can help.
I am uk citizen and national.
In Dec 2008 I got married in Pakistan and in July 2009 my wife had her spousal visa approved. Unfortunately before she came over the marriage broke down and we separated.

Now I am hoping to re-marry a girl in pakistan who I met and got engaged to last month. This time round myself and fiancee got to know each other before we got engaged so am happy with her and she with me.. now my question is with regards to the correct process to follow so I don't have issues when applying for my fiancees visa once we are married.

Firstly my first wife and I have a recently had a pakistani divorce , and was told i would need to apply for a divorce through english courts aswell due the fact that her visa was approved, even though she never came over.. is this the case? I have started proceedings but was wondering if i would have to wait until the english divorce comes through before re-marrying.

Secondly do i need to inform UKBA of my first divorce, even though her visa has now expired and she never entered the uk? Or do i just need to give proof of divorce once i apply for a visa for my new wife?

Any help / advice would be appreciated. Thanks

You dont need to go for another divorce in english court. Your original divorce document can be presented as proof of your divorce.

You must inform UKBA that you got divorced (even if the leave to remain has now expired) & include a copy of the judgement & state that you no longer wish to sponsor your ex-wife's LTR

After this there should be no problem in applying for a new dependent visa

Does anyone think there will an issue with the fact that I have been divorced once already from a marriage in which a visa was already granted, and now I am re-applying again for a visa for a second marriage. Will I have to show extra evidence as to show the marriage is genuine?

Logic says, just because you once had a divorce (and UKBA had issues dependent visa), UKBA will think twice before issuing the visa for your current/to be partner. They are not nazi, however, case may be referred to but in theory you should not have a problem if you have patience.
