Visa Extension!! please help

Post by andrew234 » Wed Mar 07, 2012 1:32 pm

i have been studying in my university for 3 years and im suppose to finish my degree in last month . it was my last semester and i sat for 4 modules but i passed only 3 of them only. im aware of the fact that i will not be able to PSW visa, but now my university is asking me to leave the country and come back for the resit. my visa expires on june 24th and the resit exam on july 5th. they are refusing to issue me a CAS letter. its too expensive for me to go back and make no sence since i have visa. i need to extend it for only 2 weeks time.. please help me regarding this matter

it's probably to do with the 60 day rule. See tier 4 sponsor guidance para 423

you can legally stay in this country if your visa is less than six months. Doesn't matter if you've finished your course or not, your visa won't get revoked

that's not the issue - the issue is he can't get a CAS due to UKBA guidance to sponsors unless he returns home.

Do you wish to have valid Tier 4 leave on completion of the exam to use for switching into some other immigration category?. The reason I ask is because I've seen situations on this and other forums where, rather than issue a new CAS for a Tier 4 visa to a student who merely needs to re-enter the UK to resit an exam or module, the sponsor asks that the student leave and then re-enter as a student visitor (with all of the relevant information). I realise that this does not solve your problem of returning but I wanted to hi-light what could happen. There would be no switching allowed in such instances.

So, unless you really need to have valid leave for switching purposes, or are adamant about not leaving and returning, you might consider overstaying for those 14 days. Not an ideal scenario but it's generally accepted within the rules that an overstay of 28 days does not have a negative affect on future applications.

or you could make an FLR(O) application shortly before your leave expires, which would not be decided before your exam finishes.
