Hi All,

Suppose one submits the documents for tier-1 extension by post and it is received and money is deducted. Normally, I would send the documents within last 28 days of my visa expiry.

Now, if someone hasn't received the biometric appointment letter for a certain period of time and if the date has crossed the visa expiry date then will he/she be entitled to stay in UK?

Let's say - visa expires on 31st Jan
Application submitted - 1st Jan
Received - 7th Jan
Money deducted on - 12th jan
BIOMETRIC RECEIVED - 3rd Feb which has crossed 31st Jan

So, legally, should anyone still stay in UK?

Read other posts first.

You would still hold the same visa status as you had before application. You would be covered by Section 3C of immigration act 1971.
