PSW application- Overstayer

Hi,
I had applied for an extension for my student visa in the month of May 2011, as my visa was expiring on 29th May 2011. Unfortunately due to problem in the size of the photograph the application was returned as invalid on the 2nd of June 2011. I consulted the visa officer at my university whether I should apply for a fresh application, and the officer advised me that since the documents were returned invalid after my visa expired I would be tagged as an 'over stayer' and there are different rules applied while re-applying for an extension and also their was potential risk. After a lot of discussion I planned to return to my home country India on 12th of June and planned to complete my dissertation in India. Now, I have passed my MBA in the month of Jan 2012 and I wish to apply for my PSW visa. I have the the required funds of 2800GBP for 90days and also all the relevant docs from the university.
My only question is
1. Whether I can apply for a PSW visa from India, considering the fact that I overstayed for around 10 days, which is still under the automatic refusal period of 28days.
2. If I can apply, do I have to mention the number of days I overstayed.
