Suggestion about employer letter for ILR

Suggestion about employer letter for ILR

Hi All,

For ILR application would you guys recommend to submit employer letter from all x-employer in last 5 years?

Finish 5 years on 23.03.12. Applied for PR on 05.04.12 for ILR
Tier 1 (General Migrant) : 08.05.2009 - 08.05.2012

If applying on the basis of Tier-1, letter from your current employer should be enough.
Also remember to submit your original WP Letter to cover the time you were on WP.

employer letter is not mandatory for tier 1 however some case worker ask for it - so something good to have.
for WP period, P60s/45s or payslips are needed to prove that you met immigration condition during that period i.e. worked for the employer that sponsored your WP.

Only thing is that I changed my employer September 2011 which comes under last 12 months. I am getting letter from current employer. do you think getting from previous would help? (i would like to ignore though)

Letter from current employer should be sufficient.

Original WP Letter is the WP approval letter you got for your WP. If you don’t have it, it won't be an issue.

can an ILR application be refused if no employer letter provided? i mean is it at Case Worker's discretion of is there any rule?
it is for WP->HSMP->Ter1->ILR route.

I don’t think so it’s a mandatory requirement but I see every day on this forum that people are taking it with them.

There is no harm in taking it with you (as it’s shows you are economically active and would not need benefits straight away after getting ILR) and it doesn’t cost you to get one from your employer.

I am myself planning to provide a simple employment letter (with my name, title and date since employed and that’s it).

It’s doesn’t need to be very complicated like Tier-2 employment letter which needs to have the salary threshold, SOC code and a statement from employer “that the employee will still be needed in future”.

Section 11: Documents
Item 11C: Employment not requiring a work permit If you are applying for indefinite leave to remain on completing 5 years’ continuous stay in the UK in one of the employment not requiring a work permit categories listed below, in addition to the relevant documents in 11A, you must provide the following:
1. Recent document(s) from your current authorised employer confirming that you are still needed for the same work and that your employment with them is continuing.

Do you think it is relevant? Can we say that employment while on Tier1 relates to this as not work permit is required?

As per my knowledge if you are on Tier1 it is for you so you need a letter from employer. (I'm not 100% sure though)

I do not think Employer letter is mandatory for ILR based on T1G.
There are several anomalies in SET (O) form and guidance.

11C is not the correct section for Tier 1 - the relevant section is 11L

I would agree with nnj10:

Similarly: on page 22 of the SET(O) form where it says go to section 11 – Documents

I think it should say go to Section 10 – Biometrics (as without filling the Biometrics section, your application is invalid).

Guys,

I was filling in my application for ILR under T1G last night and got stuck on this one as well. I think the clue is in the statement in bold below. If you are not in one of these employment types, you do not require a letter from your employer... At least, that is my interpretation.

a) Minister of religion, missionary or member of a religious order (see Note 6)
b) Representative of an overseas newspaper, news agency or broadcasting organisation
c) Private servant in a diplomatic household (see Note 7)
d) Overseas government employee
e) Member of the operational ground staff of an overseas-owned airline
f) Domestic worker in a private household (see Note 7).

Yes, I spotted that too.
On Section 10 It clearly says Biometrics Section is mandatory, if not filled your application will be invalid.
