child Benefit - Please help seniors

Post by mummyley » Mon Mar 12, 2012 10:07 am

Dear Seniors/Experts/Moderators,

I looked for my specific issue on this forum and couldnt find a solution.

My wife is under ECAA- 1 Turkish visa. I am on Tier 1 General visa ( Indian citizen ) applying for ILR in 3 months. We have a new born daughter who is dependent on her mother under ECAA-1 Dependent and have a turkish passport.

My wife applied for child benefit and she received a cheque from child benefits team last week. I'm worried that this might jeopardise my ILR application. Its only me who will apply for ILR. My wife and daughter will not apply with me, they will continue to be in their visa.

My queries:

1- Please let me know if my wife getting child benefit ( only on her name ) will be a problem for me when I apply ILR in 3 months. ( I know I am not supposed to get any benefits, but when she send her details, they mentioned she is eligible for child benefits )

2- Will it be a problem for my wife when she will apply to be my dependent after I get my ILR?

Please advise me, I clueless and stressed. Seriously I didnt know child benefit team will pay us without confirming our details. ( I thought I will not get it any way ) I accept my mistake. ( I should have checked earlier with my wife if she applied for such things )

Many Thanks

mummyley

Before posting did you look at the "Detailed Public Funds guidance" pinned topic, in this Claiming Benefits section, and then open the document linked to in the open post in that topic?

I suspect not, but please now do that, and then search for the word "Turkey" and you will see that citizens of that country are entitled to claim a long list of benefits, including Child Benefit.

Thanks John for getting back to my query.

I did have a thorough look in to the document you mentioned, I can see Turkish citizens are allowed for getting child benefit.

So I beleive my ILR should be OK given I am applying on my own.

Secondly, on ILR form page 11 ( section 5.5 ) there is a question:

5.5- Are you receiving any public funds ?

Can I say no to this !!!

Many Thanks,

Mummyley

Sorry few more queries- wanted to clarify with you

Post by mummyley » Tue Mar 13, 2012 11:58 am

Hi John,

1- Is it correct to believe that my ILR wont be affected even if my wife ( Turkish ) claims benefits ( given I am applying on my own ) .

2- will it affect when my wife applies to become my dependent ( when she applies after 4 months when I have my ILR ) ?

2- The case worker will not know that my wife is claiming benefits when he is looking on my case when I go to PEO? Is this correct?

Sorry I promise no more questions from me here after

Thanks
