DIFF PAYMENT CYCLES FOR 2 DIFF EMPLOYERS (1 ACCOUNTING YEAR)

Hello

I worked for two different employers during the year 2011 who have different pay dates.

The first company's pay day was 15th of every month while the second company which I currently work for since the middle of last year pays 25th monthly.

I had a break between these companies for example Jan - March. 0 earnings in April and then started with current employer in May.

Question: can I claim 15th Jan - 14th Feb as an earnings cycle for Jan - March? and then 01 May -31st May as the cycle normalises and I'm being paid on the 25th for the month worked?

It's not rocket science but I'm a bit confused and wouldn't want to make any obvious errors that can be avoided by consulting you guys.

In your previous employment, was the salary month 1st to the last day and you were just being paid late? Or was it from 15th of last month to 14th of current month and then you were being paid on 15th ?

SERIOUSLY !!! Are we still not clear on this yet !!! I don't want to start a rage of words but, a "Highly Skilled Person" should have figure this out by now, well at least from previous threads and subsequent responses.

To conclude very briefly, please answer yourself the following -

Employer 1 - Pay FROM (NOT THE PAY DATE, THE PERIOD FROM WHICH YOU ARE BEING PAID)
Employer 1 - Pay TO (NOT THE PAY DATE, THE PERIOD TO THE DATE WHICH YOU ARE BEING PAID)

Employer 2 - Pay FROM (NOT THE PAY DATE, THE PERIOD FROM WHICH YOU ARE BEING PAID)
Employer 2 - Pay TO (NOT THE PAY DATE, THE PERIOD TO THE DATE WHICH YOU ARE BEING PAID)

NOW TAKE THE EARLIEST "FROM DATE" FROM THE TWO EMPLOYERS AND ADD 364 DAYS TO THAT.

That will be your yearly income

I literally got kicked out from PEO Solihull yesterday because my first employer's pay date was 15th of every month and my current employer is the 25th. I was accused of over-claiming periods.

When I asked for clarity on this forum - my intelligence was questioned (see below).

Now I have to send application by post before my visa expires!

I pray you don't go through the pain I'm suffering now and you meet a tolerant person at the verification.

First of all, trust me, no one takes any pleasure on this forum knowing a fellow member has suffered what you have. Second of all, no one on purpose will give you the incorrect advise. And also, you are always advised that you should not take the advices given on this forum as professional advice.
Going back to your awful experience, as asked in separate thread, can you elaborate on what grounds they did not consider your application to be lawful? The reason is, I have very similar case as you and in the same PEO office in few days time. 2 Employers, 1st paid on 15th of Month, 2nd paying on 20th of the month.

the officer was so fixated on 15th and refused to acknowledge that it is merely a pay date in the period 01st -31st.

is there any body out there that has a similar pay structure and was able to apply successfully?

my visa expires this week and i need to send my application by post. please reply only if you have something constructive to add.

I don't have a similar experience, but if the PEO officer said that an earning period beginning on 15 January should end on 14 December I think he's wrong... if it was beginning on 1 January it would end on 31 December. So if it begins 15 days later - on 15 Jan., it should end 15 days later - on 14 Jan. of the next year.

Maybe it would help if you could get a letter from each of your employers, current and previous, stating that the payment for each month was made on the 15th (or 25th) of that month (or the next month, I'm not sure how it worked). Then it could be more clear which months you are claiming earnings for, without relying on dates of payments.

Fair enough. I do not have anything more constructive to add then. Furthermore, when I mentioned "Legitimate points" I only meant, if the points you claimed were claimed lawfully. As explained, I have similar situation as you and appointment at same PEO very shortly and would feedback under a separate header.

Sorry to have heard about ur tragic experience. But still, to me it seems that more than error on your part, it was officer who was stubborn and did not want to listen to you at all. Again that is my assumption and not necessarily the fact.

@N2012 Thank you for confirming - it was just an unfortunate experience that I don't wish on anyone.

I showed an employment letter for each company , that had month I was claiming for, pay date, gross and net for the month. It was the pay date that caused my problem as she saw it and refused to reason!

For everyone out there, that still has PEO appointments- go in there assertive to explain your evidence if you have your facts right and together.

I do not want to rub salt into your wounds but just to let you know that I appeared in the same PEO office as you did and with same story of 2 different employers paying on 2 different dates as you did - Visa was approved in 15 mins.

It was an unfortunate circumstances in which your CW was being ignorant and did not listen to you. I couldn't walk into your shoes to understand the feeling but I wish all goes well for your application.
