Switching from Tier2(ICT) to Tier 2 (General) Dependent

Post by singhpi » Thu Mar 15, 2012 12:12 am

Hi,
I am currently on Tier2 (ICT) visa and my husband is on T1( PSW) visa and his employer is willing to sponsor his Tier 2(General) visa. We are both in UK now and I am planning to apply for a Tier 2 dependent application. Can i switch from Tier 2 (ICT) to Tier 2(General) dependent within UK or do i need to go back to my home country and apply as a dependent from there?
Please advice.

Thanks

I doubt if there are many precedents for this situation.

My opinion is that since you are already in the UK in another immigration category you can apply in-country. Although under "switching" this scenario is not specifically mentioned in the Tier 2 policy guidance nevertheless in the Introduction they say that:

A family member of a Tier 2 and Tier 5 Points Based System migrant applying in the United Kingdom can make their PBS (Dependants) application online or using the equivalent paper application form.

Although as a dependant you are generally allowed to work your present status as a Tier 2 ICT migrant will have to come to an end.

It goes without saying that all conditions for a dependant application would also need to be satisfied.

Suggest to put your question to the Immigration Enquiry Helpline (0870 606 7766) - best to phone in the afternoon, they are less busy.

Took a consultation from the solicitor and it is confirmed inorder to switch into tier -2 dependent, it will be required to go back to home country and appy.
