ILR-JR (date when hsmp applied or approval received)

Post by antus » Thu Mar 15, 2012 12:22 pm

Can someone please help here - I applied for HSMP on 25th Jan 2006 and received on 3rd May 2006 (delayed because it was initially rejected but successful on appeal).
Will I fall under 4 years rule for ILR, for which cutoff date was 3rd Apr 2006, since I applied on 25th Jan 2006.
or 5 years rule (since I received my application on 3rd May 2006) ?

Apart from my reference number, there is no other document. Will that suffice as proof ?

Thanks,

Naveen

Please refer the policy document for settlement of HSMP category
5. Paragraphs 7- 26 of this policy document cover migrants who:
a. Received an HSMP approval letter issued on the basis of an
application made before 3 April 2006; and
b. Were granted Entry Clearance or Leave to Remain (LtR) on the
basis of that letter; and

Since your application was prior to 3rd Apr, and you were given EC on the basis of that application, you fall into 4 years for settlement category

Thank you very much for your reply.

That was also my understanding but when I called up home office, they said it will be based on date of received. I can see that the policy document clearly states that it will be based on date of application.

Also, do I need to submit any document to prove that I applied on 25th Jan 2006 or the reference number of the HSMP application will be enough for them to find that out?
I don't have any document except my bank statement transaction that shows that money was deducted for hsmp by ukba.
