UKBA allows applications for the 10 year long residence ILR to be submitted up to 28 days in advance of the qualifying continuous residence period.
Does this mean that:
1) one can only apply early, whereas his/her visa will still need to cover the full 10 year period;
2) as long as the current visa expires no more than 28 days in advance of the full 10 years period, the application would be valid and ILR will be granted.
For example, if someone enters UK on 01 Jan 2000, and his visa expires on 5 Dec 2009 (26 days before the qualifying 10 year period but within 28 days), can he get the ILR?
