Tier 1 visa extension for 2 months

Tier 1 visa extension for 2 months

Hi, I entered UK on 15th Feb 2008 (visa stamped on 3rd Feb 2008 ) with my family on tier 2inter co.(work permit ) valid till 03/2/10. I renewed the same in Dec 09 under the same category ( tier 2 PBS-transititional arrangement) and visa became valid till 14 Jan 2013. Since i can apply for ILR a month in advance before expiry of 5 years so my case was straight forward for IlR. But I switched to tier 1 category on 27th nov 2010 and visa became valid till 27/11/12. Now I am short by 2-3 months in order to get my ILR. Please advise if I really need to extend my visa for such a short period.

As far as I know, if you are falling short of ILR qualification by 3 months, you are okay, thats according to the current rules.
An [Expensive] Immigrant journey has ended 19/08/2015. Good luck to you all out there...

Thanks, shall I assume that I can apply for ILR IN NOV12 ie 3 months before completing 5 years. As per rules you can apply only 1 month before completing 5 years

You can't apply for ILR three months before completing your 5 years as your case is not the one where the following is applicable.

Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but due to
delayed travel will not have spent five years continuously in the UK before their current leave
expires. Caseworkers may count the period between entry clearance being granted and the
date the applicant entered the UK towards the five years, provided this period was not
longer than three months.

Thanks, In my case there is hardly any difference ( 12 days only )between entry clearance and date of entry into UK. Please suggest

You can only apply maximum 28 days before your visa expiry for ILR, so I don't see any option other than another extension.

May be someone else on board will be able to help in you better, as I have limited knowledge which I have shared I can't suggest any other option.

I perhaps misread that - to clarify, you can apply upto 3 months in advance of your fully completed 5 years that you normally need to qualify for ILR, only if you had delayed your entrance to the UK after your entry clearance date.
