EEA2 residency

Hi everybody I am Denzel.
I'm looking for a help. Maybe someone has been in this case before or knows someone who'd been in this case before.
My wife is european and I'm not.
We were married 4 years ago in her country . So she found a job here in the UK since almost 2 years. She came first alone and I've joined here 11 mounths ago in the UK with a clear family permit.
As soon as I arrived, we submitted an application (an EEA2 )to the H/Office.
But since then, we still have no answer from the home Office even though
The EC regulations requires: " the H/Hoffice to deal with EC matter with up to 6 months whatever complicated a matter could be ".
My question to everyone who could help is: what can we do in this kind of situation?

Have you involved the MP for the area in which you live? If not certainly do that. It is amazing how a slight amount of pressure from an MP can awaken IND!

Thanks Jon for having reacting.
Of course, I had been in touch with the MP who wrote to them twice.
The first time he asked for an updape of my application, and they responded that my case was not regarded as straightforward and the they don't have a scaletime of which they are going to take a decision on my case and caseworker were working on it and will do thier best to give thier response as soon as possible.
That was amizing to us (me and my wife), a mounth after the stuation was still the same.
I wrote again to the MP, say that we were astonished by the HO letter.
Why do they say Our situation is not straightforward?
When they are supposed to give thier decision?

The MP wrote to them and They wrote back to the MP just saying that our case was complex (We can not understand because we are married since almost 4 years and we had provided them with all documents).
And the MP said to us that He is sorry because he can't do anythung else for the time being.

But reading that letter, we realise that they didn'it answer to the MP's questions about the reasons for which our case is not regarding as straightforward?
and When they are supposed to give their response.

So that say, we don't know what to be done now after almost 11 mouths since we submitted our application.

Hi, have you tried writing to the Complaints Unit at IND? If not, try that. Details on this IND webpage.

Also, have you contacted an MEP? Given that this is a European application we are talking about, a letter from the MEP pointing out the 6-month time limit for dealing with such applications might just apply the mind of IND.

Thanks for your proactivity.
In fact, I've wrote twice to the complaints Unit but nothing even just a acknowledgement letter stating that they've recieved a complaint.

And was is true, is that I had never had an idea of the MEP.

The easiest way of locating your MEPs, and in the London area there are nine of them covering the whole London region, is to go to :-

-: then enter your postcode. In the right-hand column you will see the 9 MEPs for your area listed. You will notice that there are for a number of different parties. There is absolutely no need to write to any more than one of those MEPs ... choice one for a party you or your spouse might support.

I just wonder Whether there is a postal address to write the MEP?
Because, as you suggested, I went to the link writetothem, and sent an e-mail, but I'm a bit worried since there's not even an acknoledgement of my lettre.
Besides, I've been told about the "freedom of information act 2000".
Does that act mean something to you?

Hi Denzel,

it took my wife four or five months to get her residence permit last year. We got married in July, she got her family permit immediately and joined me a few days later. We applied for a residence permit for her in August, and it was granted in December.

The wait can be frustrating, but don't forget that you don't need the permit in order to look for work, register with a GP, etc. Your passport with your family permit is good enough for that. If your passport is with the Home Office (always a bad idea to send it from the beginning) just say so and quote your reference number.

Yes, as you said waiting is frustrating, but as far as I'm concerned it's becoming more than that man, because just in a week, it's gonna be 11 months since....
Thanks for your idea about the GP, it's something I gotta do.
However, as far as the work is concerned, it's not easy really, because when apply for jobs, I attend some interviews (a lot actually) but when it comes the question of my ID, I do explain them my situation but they seem not to understand and don't know that I have the rigths since my application is in progress with the H.O IND.
I always hope someday to be in front of a recruiter who knows about or has already dealt in the past with a candidate such I.

If there are any futher ideas, i'll appreciate.

You have the right at any time to ask the IND for your passport back without withdrawing your application. One of my colleagues was also waiting for an EEA residence permit which didn't come for ages. At some point he and his wife needed to travel, so his wife went to Croydon to get their passports back. They made her wait several hours, but to her surprise when they called her they not only gave her the passports, but the residence permits as well. They stamped her husband's passport right in front of her.

The IND only needs the original passport in the last phase of the application, when they physically need to put the stamp in it. Up to that point you are allowed to submit a certified copy.

But these are things I did not know at that time.
Withdrawing my Passport now After eleven months with an expired Family Permit in it , .... you see what I mean?
So we really don't Know......

For instance, we wrote a letter to complain last may, we have just received the H.O acknoledgement 3 days ago.

That is why the frustration is even higher an higher.
