wrong age points given need urgent help

Post by barfl » Wed Mar 28, 2012 10:25 pm

I was born in April 81, I applied for the tier 1 initial application
and had visa from 29th may 2009- 29 may 2012 three years ago, when they gave me the this visa, I was
28years and 1 month, However I just noticed now in my old home office letter, they gave me
only 5 points instead of 10 points. I will apply for my extension in few days
time, How much points will I get now for my age now as it is not my mistake, I need 10 points to meet my
eligibiliy 75. Could anyone please clarify on my issue as soon as possible.

Thank you and Kind Regards.

Shed some light - when did you make the application? Was it in May 09?

yeah, I made my tier 1 application (requesting for 10pts age) in 5th of may 2009 and had my visa dated on 29th may 2009- 29th may 2012. My birth date is april 1981. In 2009, i had enough earning points, eventhough they gave me 5 points ffor age i had my tier 1 visa without problem. But now for my tier 1 general extension, it looks i haven't got enough points if i use just 5 points as according to my initial application. I would like to apply in few days time. I need 10points for the age. Thanks for helping me on this issue, do ask me if you got any questions about the issue. Thank you.

Don't worry about the points that were awarded in the past. Calculate the points on the PBS calculator now and see if you get the necessary points. If you do, then you should be okay.

As per the guidance, you should have got 10 points for age when you initially applied for T1

in any case you must bring this to UKBAs attention

Thanks sage, as you said, I tried with the Point calculator, it gave me 10 points, so it looks okay, I will proceed with my application. Big relief. Also I got another question, one of my employer paid me the salary a week early instead of the usual pay date. like every month salary he pays the 3rd of next month, however the particular month, he paid me the same month (for example paid march 2012 salary on 29th march 2012), is that alright.

Salary point will be fine. I have concerns around the age points. Because when your application is assessed, page 29 of the form, you would have ticked 10 points (as you claimed) however, you were only awarded 5 points and it may prompt further questions. Are you sure you were only awarded 5 points for your age and that 5 points does not relate to uk education or something?

yes thats right exactly, they gave me 5 points for age and 5 points for experience. I didn't really interested in 2009 about that(i know it was a mistake that time by homeoffice) about that when i was received my visa, as getting visa is important and also who knows they will change the regulation saying that you will get the same points as in the initial application. However, after that I forgot about that, now when I started to apply( i thought i will get 10points), i tried to bring all my old letters to makesure everything is alright, unfortunately the letter which stated that 5 points for my age in the initial application (now i realise what happened 3 years back) which is really shocking for me. Are you sure on this issue or do you think i need to wait for a senior moderator's reply before I apply. Anyway thanks for your answer which gave a bit of relief.

Well, this is a public forum and different individuals will have different views and opinions. Logically, you should not have any problems (that is my opinion) as CW should be clever enough to spot that. Good Luck

Thanks for your reply sage. Incase if they refuse me on the reason, saying that, 'we have given 5 points for age based on initial application', then i can appeal against it by myself is that right and what are the procedures . Thanks for all the help and replies.

I do not see this going that far. Like said, you should be fine :) Worse come, yes, you should be able to challenge that legally. But it will remain to be seen if not notifying UKBA remains error on your part as much as their mistake. Don't panic, take it as it comes If you are going for PEO, do not mention anything unless asked.
