Can i stay in UK on Tier -2 ICT visa on loss of pay?

Post by rpquery » Thu Mar 29, 2012 1:09 pm

Hello

My work with my current employer will end in May 2012. As I am staying with my family in UK and my kids are studying in the school, I plan to extend my stay for another 2 months on loss of pay [leave] and then return back to my country to work for the same employer.

Following are my questions:
1- Please suggest if this is possible?
2-And how long can one legally stay in such situations?
3-Is there anything to do with COS?

FYI: I have come to UK to work on an Tier 2 ( ICT ) and my current visa is valid until Dec 2012.

Thanks a lot in anticipation.

Regards
RPQ

From the time when your job finishes end of May you will cease to be a sponsored migrant, i.e. your sponsorship will come to end end. Your sponsor/employer has to report this to UKBA.

UKBA will curtail your leave to 60 days starting from the date they make their decision (which may well be some time after the date you actually finish work)

Since you only want to stay another 2 months there will be no problem.

For reference see clauses 221-225 of the Tier 2 Policy Guidance valid from 6 April 2012
