EACH CLOSING DAY BALANCE OR CLOSING TRANSACTION BALANCE ???

Post by bhatti_pk » Mon Apr 02, 2012 1:22 am

Hi every one,

Iam currently in a deep trouble of maintenance of funds for my TIER1 extension. i have been maintaining the funds for my TIER1 extension since 29th of November 2011.
But the problem exists is that, my account normally runs with huge number of transactions every day. similarly, on 28th of February 2012; their was around 10 transactions on my BARCLAYS account. For the first three transactions my account balance was around £830. Later in the same day it has gone for £770 for two transactions in the same and has picked up again to £840 for five more transactions in the same day. I has more than £800 at the end of the day.

For this i need help from you clearing me that would it affect my maintenance as i had missed out £800 for two transactions but has £800 in the same day as outstanding balance. Pls help me as i want to apply in a day or tow! Please help and guide me on this !
I don’t have funds in any other banks. The above is the only one bank.

I think you may or may not be fine.
Refer the Policy Guidance on the below link.

http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

Refer page 29 for below.

167. Where an applicant is providing
evidence of maintenance from a single
account, we will always assess the funds
available to an applicant from the closing
balance given on the document provided.

Here it says Closing balance. But further below it states

that there are enough funds present in
the account (the balance must always be at
least £800) covering the 90 day period before
the date of application;

As per your scenario, closing balance on each day is more than 800 GBP but not always based upon transactions.

Someone who has actually gone through this can confirm but as per guidance it seems both ways.

Thank you for your reply!
I have Barclays Bank statements. In Barclays bank statement they always shows the CLOSING BALANCE OF EACH DAY, they NEVER show the balance of each transaction on same day (In Paper statement).
For Example:
Closing Balance: 07 Feb is 850
08 Feb: Money out: 70 -------- NO BALANCE SHOWED IN BANK STAMENT
08 Feb: Money out: 10 -------- NO BALANCE SHOWED IN BANK STAMENT
08 FEB: Money In : 80 : ------- BLANCE is 850
09 FEB START with 08 FEB closing balance of 850 .
This is the format of Barclays, they always out the money first and then in the money, finally they show the closing balance of each day.
Now I really don’t know, what should I do.
@mantasingh yes, I’m agree with your statement, this requirement in policy guidance is confusing, that’s why I want to confirm it form gurus, or anyone who did go through the same situation.

will appreciate the swift response, as I wanna apply as soon as possible (within 2-3 days)

Should be closing balance on any given day. The maintenance funds cannot be checked for each transaction if you are showing your current account for maintenance as it is bound to have multiple transactions on the same day.

@QuickSam ! Thank you very much sharing this.

Is it your personal experience? or it's just your understanding . . .

I'm trying to get a letter from BARCLAYS but they said we can't give any letter for personal account and we can only give the statements.

Please advise! is it fine If I just send them my BANK STATEMENTS . . . do you know anyone who had the same experience and got the visa.

This is just my understanding as when I applied I never cared about the maintenance. I had savings well in excess of the required amount.

Bhatti, salam

I guess this is now up to case worker's discretion, whether they take it as below 850 or not!!

My understanding is it should never drop below 850GBP for consecutive 90 days period. I would suggest you to consult a solicitor, i know it will add to your cost but its worth doing so.

Hi ,

Your case is fine, as the balance not printed on the statement for each transaction this could not be verified by UKBA by any means.
Because i don't think UKBA will take the previous day end of balance and will calculate balance on their own for each transaction you did for all next 90 days.

Thanks,
Subbu.

@chsubbu33

Thank you for your comment. I really appreciate your time. I mean I'll apply the case anyway, If someone will put the case of his/her experience on same scenario and haven't got the visa, then I'll stop my case. otherwise I may send the application tomorrow after lunch time.

I have sequenced all the documents.

Now If someone will surely discuss here that it will NOT be an issue, then I'll be relax for next 2-3 month while my passport will be back from home office.

@usman81
w/salam brother!

Yar you are right, to contact a solicitor is fine, but wanna apply tomorrow before new fee is going to apply! If I'll contact to solicitor, they might not send my application tomorrow or day after tomorrow and then first I need pay solicitor and also new fee would be apply on my case!!

I do not want to be a horrible person here. There is nothing in guideline which confirms what you are suggesting. Just because bank statement do not show the balance after each transaction, it does not mean "CASE IS FINE.....". And I am not sure where you got " this could not be verified by UKBA by any means " You have in your application form consent UKBA to check with your bank if they want to. So, this is out of window !!! I'm sorry if this causes any panic but to me this will be hard to confirm either way. Especially when OP has a border line balance, CW might decide to be smart **** and check balance after each transaction or perhaps hold the file for further check (if OP is going for PEO appointment) and then they will have all the time in the world to check for things like this.

Saying that, he might just get under the radar without a single question being asked over this. Best practice would be to cover the shortfall from other account even if it means having the other account in different country and have a balance of exactly whats needed by OP.

I have adopted the above path when I applied for my spouse' dependent visa.

Good Luck

@raxs1983

Thank you, worth saying brother. This is the only point in my mind. What if Case worker will check transactions manually and refuse my case, it will waste my time and this problem might give me tension for 1 year (In case I'll go for appeal ......)

I wanted to apply because of new fee implementing on 6th April, otherwise If I'll wait for some time then I can recover this time before expiry of my visa. . .

Please advise now . . . should i go for it , or should i wait, As my file is ready, just need to go post office to deliver it . . .

regards,
bhatti

Also, if I could, I will try to find bank account under my name (be it joint with anyone or not) which will help me cover the shortfall

I'm aware of this option, but brother, as I mentioned early in my thread that I have only one account.

I have one account in my home country, but my family never keep my money in my account :-) unfortunately they have my singed checks and they get all the money the day it transferred into it :-)

Sure, I understand but just wanted to reiterate the options available to you :) I hope all works out for you

@raxs1983

Thank alot for your suggestions. Much appreciated !

Lets see brother! in last 2 days, I'm thinking and thinking all the time on this issue. . .

I contacted some of friends to discuss this issue. . . . 1-2 friends pointed the same thing what you described here (manually calculation of each transaction).

Although I know one person who got the VISA on same scenario, but he was on window appointment, he said the case worker didn't even question on that issue.

Bhatti, it could not have been better explained than rax did. Now this is down to you whether to risk sending application now or take a risk free route to wait until that particular's day transactions don't fall in last 90 days period.

If i were you, i would pay 500GBP more to wait for a peace of mind.

Dear usman81 Assalam-o-Alikum,
Hi raxs1983 !!

Thank you very much for your replies, yes finally I have decided to wait and then apply with new fee with full peace of mind, I'm totally agreed with both of you.

Also, last night, I spoke a friend, you got refusal on same situation . . . . so story ends here :-) now I'm waiting and will apply after a month.

I really appreciate for your suggestion ! Many Thanks.

I think it is a wise decision. It is always worth paying that extra £500 to mitigate all the anomalies. Wish you luck
