4 months gap dependant ILR or FLR

Post by umeruzair » Thu Apr 12, 2012 10:16 am

Hi,

I need an advise from the Senior member of the team and also from the people who had the similar experience in the past the question is as below,

What are the conditions for dependant under ILR? If a person married and attained Visa more than 2 years but actually entered into the country 4 months after the dependant visa then can husband (currently on Tier 1) and wife apply for ILR at the same time? Although they are married from 2 years, they have visa from 2 years but the dependant wife enter 4 months late and therefore there is a gap of 4 months to complete the 2 years period.

Please answer the above appropriately.

The visa (and residence period) is activated (date over-stamped) when the PBS dependant enters the UK. There needs to be a two year residence period but absences from the UK after the initial entry are not considered.
