New HSMP and legality in UK

Hi All

I am currently in the UK and have been overstaying for 10 months

I meet all of the new HSMP criteria (45 points for past years earnings of 45k, 30 points for degree, 5 points for earnings in the UK and 5 points for being 30-31.

I am planning on returning home to NZ to apply for the HSMP but I am worried that the fact I have been overstaying will count against my application?

I know that visas that lead to settlement in the UK do not take past immigration history into account so will they use this against me?

Is the HSMP a visa which fits into this category (leading to settlement)?

Basically just wanting find out if it is worth my while heading home and making the application?

would really appreciate some help here if possible as I'm trying to sort my options out, ie marriage or to go ahead and give the HSMp a go

It is illegal to overstay in any country where immigration rules are applicable.

You must have to head back home. But make sure that ur passport is stamped in ur country of residence on the day that the visa expires, if not u may have problems obtaining the EC if ur HSMP is approved.

Please, head back home and reapply for HSMP.

thanks for the feedback, i am well aware of the rules and plenty of people on this forum are in the same situation as myself

I was hoping for a reply from someone with some knowledge on the topic? and an answer to whether HSMP applications are considered a visa which leads to settlement and if so past immigration history is taken into consideration?
