Hi All
I am currently in the UK and have been overstaying for 10 months
I meet all of the new HSMP criteria (45 points for past years earnings of 45k, 30 points for degree, 5 points for earnings in the UK and 5 points for being 30-31.
I am planning on returning home to NZ to apply for the HSMP but I am worried that the fact I have been overstaying will count against my application?
I know that visas that lead to settlement in the UK do not take past immigration history into account so will they use this against me?
Is the HSMP a visa which fits into this category (leading to settlement)?
Basically just wanting find out if it is worth my while heading home and making the application?
